And . . . <a href=\"https:\/\/www.civilbeat.org\/2021\/12\/living-on-a-boat-is-hard-in-hawaii-finding-rental-relief-is-impossible\/\" target=\"_blank\" rel=\"noopener\">it did<\/a>, and, ironically, right smack in the district of the senator who introduced the bill, Senator Sharon Moriwaki. <em>(See Hawaii Ocean News' 2021 testimony and warning to the legislature here: <a href=\"https:\/\/hawaiioceannews.com\/index.php\/2022\/02\/09\/our-legislature-has-created-a-humanitarian-crisis\/sb795-fin-hon-public-testimony-march-31-2021-sb795\/\" target=\"_blank\" rel=\"attachment noopener wp-att-9491\">SB795 FIN HON PUBLIC TESTIMONY MARCH 31 2021 SB795<\/a>)<\/em><br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">Background: SB795 was instigated by DLNR's Suzanne Case and Ed Underwood, and introduced, strangely, in the shortened 2021 session, when there were so many other pressing pandemic-related issues that needed attention. The DLNR's goal was to get itself out from under legislative oversight so that it could move forward with its plans to privatize all of Hawaii's publicly owned harbors, handing them over to multinational corporations that have been waiting in the wings for years. <\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">When it became law, Act 42 released the DLNR's DoBOR from oversight, especially with regards to the setting of statewide harbor fees. Once passed, DoBOR\u2019s administrator, Ed Underwood, immediately took the opportunity to weaponize Act 42, using it as a rationale in an end-run, back-door scheme to evict long-time Principal Habitation permitted families from their homes by simply pricing them out of our harbors. \u00a0Mr. Underwood <a href=\"https:\/\/www.facebook.com\/sharon.moriwaki\/videos\/4548961051784908\" target=\"_blank\" rel=\"noopener\">admitted to this, full face<\/a>, during a town hall meeting sponsored by Senator\u00a0 Sharon Moriwaki.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\"><strong><span style=\"font-size: 24px;\">Newly introduced legislation<\/span><\/strong>, <span id=\"m_4702130407415648914m_-7150590800682231359ctl00_ContentPlaceHolderCol1_ListView1_ctrl0_measure_titleLabel\">Senate Bill 2058, is unapologetic: it<\/span> asks bluntly to disallow long-time legally permitted families from occupying their homes in Hawaii's harbors.<\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">During phone calls to Aloha United Way, One Oahu, and Family Legal Services, Hawaii Ocean News learned that those families losing their homes coming from our harbors will NOT be eligible for fall-back assistance of any kind.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\"><strong><span style=\"font-size: 24px;\">The legal implications<\/span><\/strong> of the measure are considerable:<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\"><em><span id=\"m_4702130407415648914m_-7150590800682231359ctl00_ContentPlaceHolderCol1_ListView1_ctrl0_measure_titleLabel\">\"If enacted, the implementation of Senate Bill 2058 will effect a public taking of private property, as the courts have determined that a Principal Habitation Permit constitutes property.\u00a0 The measure does not provide for exceptions for existing Principal Habitation Permitees, and would take effect upon the Governor's signature. <\/span><\/em><\/span><\/p>\n<p><span id=\"m_4702130407415648914m_-7150590800682231359ctl00_ContentPlaceHolderCol1_ListView1_ctrl0_measure_titleLabel\" style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\"><em>\"The bill provides no explanation as to why the prohibition should be put into place, nor what public good it would accomplish: it is, therefore, arbitrary and capricious.\"\u00a0 (Provided to us in a recent message)<\/em><br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">Oddly, the districts represented by the introducers of the bill, Sen. <span id=\"ctl00_ContentPlaceHolderCol1_ListView1_ctrl0_introducerLabel\" data-uw-styling-context=\"true\">Inouye (<span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl10_LabelDis\" data-uw-styling-context=\"true\">S<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl10_Label2\" data-uw-styling-context=\"true\">District<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl10_LabelDistrict\" title=\"Hilo, Hamakua, Kohala, Waimea, Waikoloa, Kona\" data-uw-styling-context=\"true\">4<\/span>, <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl10_LabelDistrict2\" title=\"Hilo, Hamakua, Kohala, Waimea, Waikoloa, Kona\" data-uw-styling-context=\"true\">Hilo, Hamakua, Kohala, Waimea, Waikoloa, Kona)<\/span>; Sen. Dela Cruz (<span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl06_LabelDis\" data-uw-styling-context=\"true\">S<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl06_Label2\" data-uw-styling-context=\"true\">District<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl06_LabelDistrict\" title=\"Mililani Mauka, Waipi\u2018o Acres, Wheeler, Wahiawa, Whitmore Village, portion of Poamoho\" data-uw-styling-context=\"true\">22,<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl06_LabelDistrict2\" title=\"Mililani Mauka, Waipi\u2018o Acres, Wheeler, Wahiawa, Whitmore Village, portion of Poamoho\" data-uw-styling-context=\"true\">Mililani Mauka, Waipi\u2018o Acres, Wheeler, Wahiawa, Whitmore Village, portion of Poamoho)<\/span>; and Sen. Keith-Agaran (<span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl12_LabelDis\" data-uw-styling-context=\"true\">S<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl12_Label2\" data-uw-styling-context=\"true\">District<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl12_LabelDistrict\" title=\"Wailuku, Waihe\u2018e, Kahului\" data-uw-styling-context=\"true\">5,<\/span> <span id=\"ctl00_ContentPlaceHolderCol1_GridView1_ctl12_LabelDistrict2\" title=\"Wailuku, Waihe\u2018e, Kahului\" data-uw-styling-context=\"true\">Wailuku, Waihe\u2018e, Kahului<\/span>) are largely unaffected by the changes proposed in this measure.\u00a0 Why, then, would these particular three legislators suddenly take such a great interest in something that is only of casual concern in their districts?\u00a0<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\"><strong><span style=\"font-size: 24px;\">The legislature's Ways and Means Committee<\/span><\/strong> (WAM) will hear this measure at 1:10 pm, this coming Friday, February 11, 2022.\u00a0 All boaters around the State of Hawaii are encouraged to submit testimonies.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">To submit testimony on this (<em><span id=\"m_4702130407415648914m_-7150590800682231359ctl00_ContentPlaceHolderCol1_ListView1_ctrl0_measure_titleLabel\">SB2058)<\/span><\/em> or any of the bills that affect boaters this year, go to the legislature's main webpage and register -- you must be registered to submit testimony.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">Once you've registered, the\u00a0 lower-center portion of the new page will show an orange and white icon titled Hearing Notification - click on that icon and it will take you to a new page. On that page type the bill number (including the \"sb\" - e.g., SB3131) and click on the Add button -- you can add the other bills by entering their numbers and clicking Add. The click on any of the bills on you list, and you will be taken to the page for that bill.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">The bill page is very useful: it tells you if any hearings are scheduled, if any testimony has been taken, you can download a PDF of the bill, etc. -- AND you can submit testimony on the bill, by clicking on the Submit Testimony button. Note that you can cut-and-paste your testimony from, say, a Word document, rather than retyping it in the area provided on the testimony page.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">NOTE that you can only submit testimony if a hearing has been scheduled. Therefore, staying on top of when hearings are scheduled is VERY IMPORTANT.
