Now with more than 10,000+ subscribers.\u00a0 <a href=\"https:\/\/hawaiioceannews.com\/index.php\/contact\/\" target=\"_blank\" rel=\"noopener\">Click here<\/a> to request a subscription (we do <em><strong>NOT<\/strong><\/em> archive personal information!) <a href=\"https:\/\/hawaiioceannews.com\/index.php\/about\/\" target=\"_blank\" rel=\"noopener\">Learn more<\/a> about who we are.\u00a0 <em><strong>Katherine Lindell, editor<\/strong><\/em><br \/>\n<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"font-family: Trebuchet MS, Geneva; font-size: 24px;\">The title emblazoned at the top of House Bill <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1089&amp;year=2023\">HB1089<\/a> reads as follows: <\/span><\/strong><\/p>\n<p><strong><span style=\"font-family: Trebuchet MS, Geneva; font-size: 24px;\">\"<span dir=\"ltr\" role=\"presentation\">RELATING<\/span> <span dir=\"ltr\" role=\"presentation\">TO<\/span> <span dir=\"ltr\" role=\"presentation\">A<\/span> <span dir=\"ltr\" role=\"presentation\">STATE<\/span> <span dir=\"ltr\" role=\"presentation\">BOATING<\/span> <span dir=\"ltr\" role=\"presentation\">FACILITY<\/span> <span dir=\"ltr\" role=\"presentation\">LEASE<\/span> <span dir=\"ltr\" role=\"presentation\">PILOT<\/span> <span dir=\"ltr\" role=\"presentation\">PROGRAM<\/span>\".<\/span><\/strong><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">But here's what's actually in <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1089&amp;year=2023\">HB1089<\/a>:\u00a0 <\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\"><strong>Section 1:\u00a0<\/strong> <span dir=\"ltr\" role=\"presentation\"><em><strong>\"Relating to Civil Service\"<\/strong><\/em><\/span><\/span><br \/>\n<span style=\"font-size: 20px;\"><span style=\"font-family: Trebuchet MS, Geneva;\">The very first section in HB1089 deals <em><strong>entirely<\/strong><\/em> with extensive amendments to <span dir=\"ltr\" role=\"presentation\">Section<\/span> <span dir=\"ltr\" role=\"presentation\">76-16,<\/span> <span dir=\"ltr\" role=\"presentation\">Hawaii<\/span> <span dir=\"ltr\" role=\"presentation\">Revised<\/span> <\/span><span dir=\"ltr\" role=\"presentation\"><span style=\"font-family: Trebuchet MS, Geneva;\">Statutes, <em><strong>\"Relating to Civil Service\"<\/strong><\/em>:<br \/>\n<\/span><\/span><\/span><span style=\"font-size: 20px;\"><span dir=\"ltr\" role=\"presentation\"><span style=\"font-family: Trebuchet MS, Geneva;\">- Commissioned and enlisted personnel of the Hawaii's National Guard<\/span><br \/>\n<span style=\"font-family: Trebuchet MS, Geneva;\">- Positions filled by persons employed by contract<\/span><br \/>\n<span style=\"font-family: Trebuchet MS, Geneva;\">- Positions that must be filled without delay to comply with a court order<\/span><br \/>\n<span style=\"font-family: Trebuchet MS, Geneva;\">- Positions filled by the legislature<\/span><br \/>\n<span style=\"font-family: Trebuchet MS, Geneva;\">- Employees in the office of the governor\u00a0<\/span><br \/>\n. . . etc.<br \/>\n<\/span><\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">The above continues on for 9 full pages until we finally reach Section 2, which actually deals with the topic that is described in the bill's title: <strong>\"<span dir=\"ltr\" role=\"presentation\">RELATING<\/span> <span dir=\"ltr\" role=\"presentation\">TO<\/span> <span dir=\"ltr\" role=\"presentation\">A<\/span> <span dir=\"ltr\" role=\"presentation\">STATE<\/span> <span dir=\"ltr\" role=\"presentation\">BOATING<\/span> <span dir=\"ltr\" role=\"presentation\">FACILITY<\/span> <span dir=\"ltr\" role=\"presentation\">LEASE<\/span> <span dir=\"ltr\" role=\"presentation\">PILOT<\/span> <span dir=\"ltr\" role=\"presentation\">PROGRAM<\/span>\"<\/strong><\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">Hawaii's State Constitution clearly and specifically requires the legislature to stay on topic when introducing legislation through committees.\u00a0 <a href=\"https:\/\/ballotpedia.org\/Article_III,_Hawaii_Constitution#Section_14\" target=\"_blank\" rel=\"noopener\">Article 3, section 14<\/a> of the State Constitution reads: <\/span><br \/>\n<b><\/b><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\"><b>Article 3, Section 14 (Hawaii State Constitution):<br \/>\n<\/b><em><b>Bills; Enactment<\/b><\/em><\/span><\/p>\n<p><span style=\"font-size: 24px; font-family: Trebuchet MS, Geneva;\"><em><strong>No law shall be passed except by bill. Each law shall embrace but <span style=\"text-decoration: underline;\">one subject<\/span>, which shall be expressed in its title. . . .\u00a0\u00a0 .\"<\/strong><\/em><\/span><\/p>\n<p><em><strong><span style=\"font-family: Trebuchet MS, Geneva; font-size: 24px;\">\". . . one subject, which shall be expressed in its title . . .\"<\/span><br \/>\n<\/strong><\/em><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">The legislature was notified in testimony, well before the hearing, that HB1089 violates the State's constitution.\u00a0 (<a href=\"https:\/\/www.capitol.hawaii.gov\/sessions\/session2023\/Testimony\/HB1089_TESTIMONY_WAL_02-09-23_.PDF\" target=\"_blank\" rel=\"noopener\">see testimony here<\/a>).<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">So, we must assume then that Linda Ichiyama, Mahina Poepoe, Cory Chun, Mark Hashem, Dee Morikawa, Gregg Takayama, and Kanani Souza, a) don't really care about public testimony, b) have a pre-existing out-of-the-sunshine agenda set out for them in advance . . . and the public be damned, c) are burdened with a reading disability, or, d) all of the above.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">To make matters worse, all public testimony was 99% in opposition to HB1089, including testimony from UPW (<em><strong>United Public Workers). <\/strong><\/em>The only testimony in favor was a weak kneed, half-truth version from newly minted DLNR Chair, Dawn Chang, who couldn't muster any more than a lock-step version of Underwood's manifesto.<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">The latter shouldn't surprise, as the DLNR -- and especially Ed Underwood's version of DOBOR -- have been trying to lease out our public harbors for decades. <\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">Yes, it is <em><strong>oh-so-true<\/strong><\/em> that Underwood and his idiot brigade <em><strong>cannot<\/strong><\/em> manage our public harbors.\u00a0 <\/span><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">Fair enough . . . so the obvious solution, then, is to bring in a <em><strong>professional management team<\/strong><\/em> with marina experience to do the work that Chang and Underwood could never do even on their best day. <\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Trebuchet MS, Geneva;\">But instead of focusing on a sensible private management scheme, HB1089 asks for permission to privatize and hand over the entire public harbor system, which is like trying to kill a fly with a shotgun. Leasing our public lands changes the fundamental nature and intent of our public assets. Why?\u00a0 Because the lessee will make capital improvements to the property and will then, rightfully, expect a hefty ROI in return . . . <em><strong>creating an entry barrier<\/strong><\/em> to much of the public from what was once their land.<\/span><\/p>\n<p><strong><span style=\"font-family: Trebuchet MS, Geneva; font-size: 24px;\">In addition to being either dyslexic and\/or reading challenged -- or not giving a hoot about our state's constitution or what the public has to say -- Linda Ichiyama, Mahina Poepoe, Cory Chun, Mark Hashem, Dee Morikawa, Gregg Takayama, and Kanani Souza have somehow arrived at the rather strange notion (when viewed historically) that privatizing publicly owned land somehow solves a problem.<\/span><\/strong><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">In the case of privatizing the public's harbor system, the State of Hawaii has been directly responsible for creating the \"problem\" that needs to be \"solved\". \u00a0A decade of <span style=\"text-decoration: underline;\"><em><strong>deliberate<\/strong><\/em><\/span>, <em><strong>in-your-face DLNR neglect and abuse<\/strong><\/em> of the public's harbor system was designed to do nothing more than create a rationale and a convincer that private out-of-state multinational corporations should \"own\" public properties.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">This time <strong><a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1089&amp;year=2023\">HB1089<\/a><\/strong> tells us that it's a \"pilot\" public-private partnership. This time we're making believe that there never have existed previous \"pilot\" privatization schemes . . . except that there were: like the disastrous privatization mooring pilot at Keehi lagoon, or the awkward and outrageously expensive pilot at Kewalo Basin (doubling boater's rents instantly), or the incredibly failed \"pilot\" privatization attempt (on behalf of Larry Ellison) at Lanai's public marina. Or how about the hugely failed privatization of the Ala Wai's Texaco fuel dock property, or the catastrophically failed Ala Wai Marine property privatization that ended up costing taxpayers hundreds of thousands of dollars.<br \/>\n<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"font-family: Trebuchet MS, Geneva; font-size: 24px;\">Before any discussion about privatizing public lands takes place, there needs to be a board or a formal advisory committee established and in operation that is made up of members of the public who will be affected by this radical transformation of public properties.<\/span><\/strong><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">A laughable legislative attempt to do this takes shape in the form of <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=422&amp;year=2023\" target=\"_blank\" rel=\"noopener\">HB422<\/a>, a bill that would gut the board\u2019s power by disallowing members to advise about harbor management, the very core of their purpose and expertise.\u00a0 Members of the legislature have to understand that, after Hawaii\u2019s absolutely disastrous Covid response that forced more than 1,000 local businesses to <em><strong>permanently<\/strong><\/em> close up shop, people are watching . . . closely.<\/span><\/p>\n<p><span style=\"font-family: Trebuchet MS, Geneva; font-size: 20px;\">By privatizing public properties and handing them over to wealthy out-of-state interests, you are admitting to the public that you <strong><em>cannot <\/em><\/strong>manage public assets.\u00a0 If this is the case, what else \u201cpublic\u201d are government operatives unable to manage?<\/span><\/p>\n<p><span style=\"font-size: 20px; font-family: Verdana, Geneva;\">This is so simple that even a legislator should be able to understand this: bring in competent, experienced management to solve management issues, and leave public properties in public hands.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"font-size: 24px; font-family: Trebuchet MS, Geneva;\">Our testimony:<\/span><\/strong><\/p>\n<p><strong>An open testimony<br \/>\n<\/strong><em>(Note: This testimony has been published on the Hawaii Ocean News website so that all of Hawaii might be aware of its existence.)<\/em><\/p>\n<p>Regarding <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1089&amp;year=2023\">HB1089<\/a> (companion: <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=1387&amp;year=2023\">SB1387<\/a>):<\/p>\n<p>RELATING TO A STATE BOATING FACILITY LEASE PILOT PROGRAM<\/p>\n<p><strong>Testimony submitted by:<\/strong><\/p>\n<p>Katherine Lindell<br \/>\nHonolulu, Hawaii<br \/>\n<em>Katherine@HawaiiOceanNews.com<\/em><\/p>\n<p>On: February 7, 2023, @ 3PM<\/p>\n<p><strong>Testimony<\/strong><\/p>\n<p><strong><em>1) Unconstitutional Components<\/em><\/strong><\/p>\n<p>Firstly:\u00a0 The composition of <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=SB&amp;billnumber=1387&amp;year=2023\">SB1387<\/a> (companion: <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=1089&amp;year=2023\">HB1089<\/a>) constitutes a clear violation of Hawaii\u2019s State Constitution: the agenda items contained therein, shoehorned together in this same bill, are mutually exclusive, in violation of the state\u2019s constitution (<a href=\"https:\/\/ballotpedia.org\/Article_III,_Hawaii_Constitution#Section_14\">Article 3, section 14<\/a>). \u00a0Allowing this bill to proceed through the legislature in its present form snubs the foundational laws of this state and is a slap in the face to the people of Hawaii.<\/p>\n<p><strong><em>2) Failure to Disclose Introducers<\/em><\/strong><\/p>\n<p>Secondly: \u00a0in any open and honest government, all introducers of any piece of legislation will be disclosed.\u00a0 Why are the introducers of this bill being hidden?\u00a0 Who are they?\u00a0 Why are they hiding or being hidden?\u00a0 Some have already suggested that the hidden introducers are part of the governor\u2019s \u201cinner circle\u201d and that this is nothing more than a piece of legislation purpose-built by the governor himself.\u00a0 If that\u2019s true, this represents an ethical violation that must be rectified.<\/p>\n<p><em>You have an obligation to clarify all of this to the public before moving forward with this bill.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>3) Advisory Board Requirement<\/em><\/strong><\/p>\n<p><strong><em>Thirdly: \u00a0<\/em><\/strong>The privatization of publicly owned properties is a radical alteration of intended use of any public facility.\u00a0 As such, a precursor to such a change must include a board or advisory council made up of the affected public. <em>The latter needs to be completed and operational first.<\/em>\u00a0 This cannot be the \u201cgutted\u201d version of a board\/advisory committee suggested by <a href=\"https:\/\/www.capitol.hawaii.gov\/session\/measure_indiv.aspx?billtype=HB&amp;billnumber=422&amp;year=2023\">HB422<\/a>, but rather, a fully functioning board that is looked to for advice regarding changes to and the operation of the affected public properties.<\/p>\n<p><strong><em>\u00a04) Legal Irregularities<\/em><\/strong><\/p>\n<p>Fourthly: <strong><em>\u00a0<\/em><\/strong>There are legal irregularities that are currently taking place, ongoing, in the administration of the public\u2019s marina system that must be resolved first, before moving forward with this bill.<\/p>\n<p><strong><em>To wit:<br \/>\na) <\/em><\/strong>An ongoing DoBOR-sanctioned administrative procedure that has taken thousands of dollars from hopeful principal habitation permittees, while denying them access to the very same privilege that they had signed up and paid for.\u00a0 The State needs to be reminded, once again, that the exchange of money from one hand to another constitutes a contract.\u00a0 The State is currently reneging on that contract in real time and over a protracted period of time.
